Welcome to Creativity Uncorked! By accessing or using our website, CreativityUncorked.com and by booking or participating in any of our workshops, classes, or purchasing products, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully. If you do not agree with any part of these Terms, you may not access the website or use our services.
1. Acceptance of Terms These Terms constitute a legally binding agreement between you ("User," "Participant," "Customer") and [Your Business Name] ("Creativity Uncorked," "we," "us," or "our"). Your access to and use of our website and services signifies your full acceptance of these Terms.
2. Description of Services Creativity Uncorked provides interactive art and craft workshops ("Workshops" or "Classes") that often include the consumption of alcoholic beverages. Workshops are held at various third-party venues (e.g., wineries, local establishments) and are designed to provide a relaxed, fun, and creative experience. Specific details for each workshop, including the project, date, time, location, and price, are detailed on their respective event pages on our website.
3. Eligibility Participants in workshops where alcohol is offered must be at least twenty-one (21) years of age. Valid government-issued identification will be required at the venue to verify age for alcohol consumption. Participants under 21 years of age are generally not permitted unless explicitly stated otherwise for a specific class (e.g., a "Kids' Craft Day" which would be non-alcoholic).
4. Booking and Payment
Online Bookings: All online bookings for our Workshops are processed through our integrated scheduling system (Acuity Scheduling, facilitated via Squarespace). Payments for online bookings are processed securely via PayPal or other payment gateways integrated with Acuity Scheduling and Squarespace.
In-Person Bookings/Payments: Limited in-person bookings or payments may be accepted at events directly via Square Point of Sale system or cash. Availability of in-person booking/payment is subject to our discretion and event capacity.
Payment Requirement: Full payment is required at the time of booking to secure your spot in a Workshop.
Capacity: All Workshops have limited capacity. Spots are reserved on a first-come, first-served basis upon successful receipt of payment.
5. Pricing Workshop prices are clearly listed on our website and on each individual event page. Prices are subject to change without prior notice, but any change will not affect bookings already confirmed.
6. Cancellation and Refund Policy (CRITICAL for your business!):
Client Cancellations:
For a full refund, cancellations must be made 72 hours (3 days) prior to the scheduled Workshop start time.
Cancellations made within less than 72 hours (3 days) of the Workshop are generally non-refundable. However, at our sole discretion, a credit towards a future Workshop may be offered.
No-shows are strictly non-refundable and will not receive credit.
Tickets may be transferred to another person by contacting us via email at sara@creativityuncorked.com or via text 785.730.9167 any time before the Workshop.
Creativity Uncorked Cancellations:
We reserve the right to cancel or reschedule a Workshop due to unforeseen circumstances (e.g., low enrollment, instructor illness, venue issues).
In the event of a cancellation by Creativity Uncorked, participants will be notified as soon as possible and will be offered credit towards a future Workshop of equal value.
7. Participant Conduct and Safety
Venue Rules: Participants must adhere to all rules, policies, and instructions set forth by the host venue (e.g., Crooked Post Winery).
Alcohol Consumption: Alcohol consumption is at the participant's own risk. We reserve the right to refuse service to any individual appearing visibly intoxicated or disruptive, without a refund. Please drink responsibly.
Workshop Safety: While we strive to provide a safe environment, participants acknowledge that engaging with art materials (e.g., paint, potentially broken tiles, tools) involves inherent risks. Participants agree to exercise caution and follow all instructions provided by the instructor regarding tool usage and material handling and safety policies.
Disruptive Behavior: Creativity Uncorked reserves the right to remove any participant who engages in disruptive, disrespectful, or unsafe behavior, without a refund.
Personal Property: Creativity Uncorked is not responsible for any lost, stolen, or damaged personal property during a Workshop.
8. Intellectual Property All content on creativityuncorked website, including but not limited to text, graphics, logos, images, software, and class materials, is the property of Creativity Uncorked or its content suppliers and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without express written permission. While you retain ownership of the physical art piece you create in a Workshop, Creativity Uncorked reserves the right to photograph and use images of class creations for marketing and promotional purposes.
9. Privacy Policy Your privacy is important to us. Our data collection and usage practices are detailed in our separate Privacy Policy, which is accessible at creativityuncorked.com. By using our services, you agree to the terms of our Privacy Policy.
10. Disclaimers The website and all services are provided on an "as is" and "as available" basis. Creativity Uncorked makes no warranties, express or implied, regarding the website's operation or the information, content, materials, or products included on the website.
11. Limitation of Liability To the fullest extent permitted by applicable law, Creativity Uncorked shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; (c) any content obtained from the services; and (d) unauthorized access, use or alteration of your transmissions or content. In no event shall Creativity Uncorked's aggregate liability exceed the amount you paid to Creativity Uncorked for the Workshop in question.
12. Indemnification You agree to indemnify, defend, and hold CreativityUncorked.com, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the website or participation in Workshops.
13. Governing Law These Terms shall be governed and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions.
14. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 7 days’ notice prior to any new terms taking effect. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
